Abstract

Law of dismissal is “Central nervous system´╝łNervenzentrum)” of employment law. According to the “doctrine of abusive dismissal” in Japan, which is developed by case law and legislated in Japanese Labor Contract Act 2007, a dismissal shall, if it lacks objectively reasonable grounds and is not considered to be appropriate in general societal terms, be treated as an abuse of right and be invalid. I will be addressing the development and sociological context of this doctrine in this lecture.
