Sector-level bargaining and possibilities for for deviations at company level: the cases of France, Ireland and Spain


In a number of EU member states where collective bargaining at sectoral and intersectoral levels plays a major role, there has recently been an increasing call for decentralization in the setting of wages and working conditions. A specific form of decentralization is the opening up of possibilities for companies suffering from temporary economic hardship, through various forms of derogation clauses, to deviate from pay norms set under agreements at higher levels. Such possibilities are controversial as they may challenge some principles of national labour law and may lead to wage declines and increased insecurity for workers. Recently, AIAS, in cooperation with the Institute for Economic and Social Research (WSI, Germany) and the University of Teramo (Italy), completed a study on these derogation clauses on behalf of the European Foundation in Dublin. A team led by Maarten Keune (AIAS) studied both the regulations concerning these clauses and the actual practice of their use for seven EU countries: Austria, Belgium, France, Germany, Ireland, Italy, and Spain. In the upcoming lunch seminar, team members Nuria Ramos Martin and Maarten van Klaveren (both AIAS) will present three of seven country cases, respectively those of France and Spain (Nuria) and Ireland (Maarten). The three countries represent widely varying regulations and practices. Yet, commonalities are that in practice the adoption of clauses that may undercut wages in the three countries seems quite limited, and that the (further) expansion of possibilities for deviation remains an issue of fierce debate between employers’ federations and trade unions.
